California Man Pleads Guilty to Defrauding CARES Act Programs and Commercial Lenders

A California man, Craig David Davis, 49, of Venice, has pleaded guilty to wire fraud charges in the Eastern District of Virginia. Davis admitted to defrauding multiple Coronavirus Aid, Relief, and Economic Security (CARES) Act programs, including the Paycheck Protection Program (PPP) and the Main Street Lending Program (MSLP), of more than $10 million.

Davis, the owner of Bright Vanguard LLC, which he falsely presented as a legitimate computer hardware retailer and storage space provider, submitted fraudulent loan applications under these programs in 2020. According to court documents, Davis falsely claimed that Bright Vanguard had substantial sales and employed as many as 17 individuals. In reality, Bright Vanguard had no employees and generated no legitimate revenue. To support his fraudulent claims, Davis provided banks with falsified tax returns, payroll documents, and financial statements.

In addition to the CARES Act fraud, Davis also confessed to his involvement in a years-long scheme to defraud commercial equipment lenders. This scheme involved directing business owners to submit loan applications for purchasing computer equipment, supported by invoices from companies like Bright Vanguard. After the lenders approved the loans and disbursed the funds, Davis and his co-conspirators kept a portion of the proceeds while remitting the majority to the borrowers. No equipment was actually provided, despite what was shown on the fraudulent invoices. This scheme resulted in over $60 million in fraudulently induced lending across more than 350 separate loans.

Davis is scheduled for sentencing on December 12, 2024. He faces a maximum penalty of 20 years in prison. The final sentence will be determined by a federal district court judge, who will consider the U.S. Sentencing Guidelines and other statutory factors.

The announcement of Davis’s guilty plea was made by Principal Deputy Assistant Attorney General Nicole M. Argentieri, head of the Justice Department’s Criminal Division, and U.S. Attorney Jessica D. Aber for the Eastern District of Virginia. The investigation was led by the Federal Deposit Insurance Corporation Office of Inspector General (FDIC OIG) Mid-Atlantic Region, the Department of the Treasury’s Special Inspector General for Pandemic Recovery, and IRS Criminal Investigation (IRS-CI).

The case is being prosecuted by Trial Attorney David A. Peters of the Criminal Division’s Fraud Section, along with Assistant U.S. Attorneys Drew Bradylyons and Katherine Robeson for the Eastern District of Virginia, with substantial assistance from the U.S. Attorney’s Office for the District of Maryland.

New Study Reveals That Small Business Can Benefit Greatly From GenAI – If They Can Get Employees to Use It

Small businesses no longer have a binary choice in front of them on whether to use generative AI. The technology can now be found within software packages, handling small tasks in the background or being directly enlisted by employees to take care of busy work.

The prevalence of GenAI has done little to diminish employees’ fears, according to a new study, “Data Privacy and Generative AI Usage,” conducted by Zoho and CRM Essentials. The report surveyed 1,000 US employees working across diverse industries, company sizes, and job titles to determine how often they were using GenAI, its use cases, and, most importantly, how employees feel about sharing personal and company data with GenAI for training purposes.

The results demonstrated that fear of GenAI remains across all employees, even if use of the technology is inevitable or it has already been implemented at the company level. However, by drawing lessons from these results, small businesses can implement a successful GenAI launch within their organization—one that reduces employee stress and enables them to focus on the higher-profile tasks so critical to SMBs.

Feelings about GenAI

All employees surveyed in “Data Privacy and Generative AI Usage,” not just daily users, expressed high degrees of concern about the technology: 46% said they believed AI was a threat to their job, and 26% said it was a “necessary evil.” Additionally, 74% of respondents claimed government legislation was needed for training AI with employee data, and 75% wanted legislation to regulate IP rights for AI content creation.

Yet, employees admitted that GenAI has provided numerous benefits, with that trend becoming more pronounced when the data is sliced for small businesses with fewer than 100 employees, constituting 37% of total respondents. For one thing, use of GenAI is more sparse among small businesses, as 45% said they don’t use GenAI at all, compared to 37% of the general survey population.

Among users, however, a higher percentage, 43%, said GenAI has increased productivity significantly, as compared to 40% of the general survey population. Also, 15% said AI has become “indispensable” to their work and only 26% have become more concerned about data privacy since starting to use GenAI.

The data shows that companies of all sizes stand to benefit greatly from use of GenAI once employees better understand how the technology can benefit them. The challenge, then, is to have employees try it for themselves, even if they’re preconditioned to dislike it.

Overcoming Hesitancy

Sales are of paramount importance to small businesses, yet so many sales teams remain disconnected from business operations, or the individual representatives become inundated with administrative tasks and lose sight of bringing in new customers. The situation becomes even more complicated when sales reps maintain their own clients and might, understandably, be hesitant to share that data with the larger organization.

The data points to a straightforward strategy: Small business owners should take a step back and consider where the data nucleus of their company should reside. For many, a centralized CRM makes the most sense, particularly when working with a remote workforce or a tight-knit team of jacks-of-all-trades. When a piece of information is updated within a CRM, other employees can receive alerts and rest assured any data they try to access later will be fully current. This unlocks better strategic decisions and a spirit of collaboration.

In addition, many CRMs now come equipped with GenAI woven into their fabric. These helpers, such as Zoho’s Zia, can handle complex calculations, data analysis and visualizations, recommendations for next steps, and automatic meeting transcriptions, leaving sales representatives free to conduct research on potential clients or hop on calls with distressed customers without worrying about falling behind. They’ll feel these tangible benefits, at which point companies can educate them on how training GenAI with customer data can improve its output exponentially.

This would also be a great time for these companies to emphasize their commitment to data privacy.

Lean Into Limitations

Despite the hype, GenAI is not capable of accomplishing every task under the sun—and, even those it can handle are prone to errors that only humans can suss out.

However, the imperfection of the technology can turn into a tool to increase adoption. If a small business has decided to implement GenAI, they can ask its employees to try and break it. Have them ask complicated questions, produce impossible results, or perform tasks of near-infinite complexity. Employees will see GenAI fail, sure, but most importantly, they will see GenAI succeed and have a better sense of how human fail safes can be incorporated into workflows to avoid errors. Once employees see themselves as part of the process, they can begin to explore GenAI’s benefits as a helper rather than something coming for their job.

Employees will be able to see the types of tasks GenAI can handle. According to the survey, 19.9% use it to quick answers to work-related questions; 15.3% create email content; 12.2% video-creation; 11.6% summarize long business documents; 11.2% to write content; 8% to edit videos; and 4.6% to write code. These represent a wide variety of work that employees will likely be happy to offload.

What’s Next?

The GenAI conversation has moved beyond the tech industry, as evidenced by the fact that all employees surveyed, regardless of industry, company size, or role within the organization, remain skeptical about the future of AI—even those who have never used it before. Changing overall sentiment is a gargantuan task no small business should ever take up, but by introducing GenAI strategically, these companies will show employees that the end goal is to increase their productivity, not replace them.

Zoho Study Reveals Contrasting Attitudes Toward Generative AI and Data Privacy

Zoho Corporation just released the findings of its “Data Privacy and Generative AI Usage” study, conducted in collaboration with CRM Essentials.

The study surveyed 1,000 U.S. employees across various industries, company sizes, and disciplines to understand how they interact with Generative AI at work, their attitudes toward the technology, and their concerns regarding data privacy.

Raju Vegesna, Chief Evangelist at Zoho, says, “The survey data demonstrates that employees stand to benefit greatly from generative AI, but their hesitancy is rooted in a lack of experience more than privacy concerns.

“Still, it is crucial for businesses to recognize the possible dangers that come with utilizing GenAI. Companies should adopt a holistic approach of gradually integrating the AI features while training their employees on how to use the technology safely within stringent guidelines to reduce risks and attain long-lasting success in the digital workplace era.”

The Rise of GenAI in the Workplace

The study highlights a significant divide between daily users of GenAI and those who have yet to adopt the technology.

Among the respondents, only 24% reported using GenAI on a daily basis, while 37% said they had never used it, primarily because their companies do not mandate its use. Despite the relatively low adoption, those who do use GenAI reported substantial benefits:

  • 40% of daily users claimed that GenAI has “significantly” increased their productivity.
  • 17% said GenAI has become “indispensable” to their daily work.

The study also revealed that GenAI is primarily used for supporting repetitive tasks. The most common daily uses of GenAI among employees include finding quick answers to work-related questions (19.9%), creating email content (15.3%), video creation (12.2%), and summarizing long business documents (11.6%).

Interestingly, only 18% of respondents use GenAI solely for work purposes, with 32.5% using it mainly for work, 22.9% for both work and personal use, and 16.5% exclusively for personal tasks.

Employee Sentiment Toward GenAI: Hopeful Yet Cautious

The study found that daily users of GenAI tend to have a more positive outlook on the technology compared to non-users. Among daily users, 78% believed that AI would have a positive impact on their work experience, while only 13% of non-users shared this sentiment. Additionally, 56% of daily users expressed comfort in sharing personal data with GenAI, compared to just 12% of non-users.

Despite the optimism among daily users, there remains a significant undercurrent of concern regarding the broader implications of AI:

  • 46% of all respondents believed AI poses a threat to their job security.
  • 26% described AI as a “necessary evil.”
  • 74% of respondents called for government legislation to regulate how AI is trained using employee data.
  • 75% advocated for legislation to govern intellectual property rights related to AI-generated content.

Brent Leary, Partner at CRM Essentials, commented on the study’s findings, emphasizing the need for companies to take a strategic approach to GenAI adoption. “Companies are rushing to implement generative AI without a strategic plan, foisting it on a workforce that’s understandably hesitant to jump in,” Leary said. “Our survey meets employees where they are by demystifying their sentiment towards AI and demonstrating the best paths forward in increasing adoption of this powerful new technology.”

Data Privacy Concerns: Convenience Over Caution

The study underscores a paradox in employee attitudes toward privacy and convenience. While many respondents expressed concerns about the potential privacy risks associated with GenAI, the majority still prioritized convenience over data protection. Specifically:

  • 67% of respondents prioritized convenience over data privacy.
  • 30% of daily users reported being comfortable sharing personal data with GenAI tools.

Among those hesitant to adopt GenAI due to privacy concerns, the top issues included sharing financial information (18.6%), personal identification details (16.8%), location data (12.2%), and health details (11.8%).

Preferences in Performance Evaluation: Human vs. AI Assessment

The study also explored how employees feel about AI’s role in evaluating work performance. The results revealed that:

  • 39.3% of respondents preferred to have their performance and behavior evaluated by humans.
  • 12.2% were comfortable with AI conducting these evaluations.
  • 16.3% felt equally comfortable being assessed by either AI or humans.
  • 22.2% were most comfortable with a combination of both AI and human assessments.

SBA Announces $1 Million in Grants to Expand Resources for Veteran Entrepreneurs

The U.S. Small Business Administration (SBA) has announced over $1 million in grant awards to three organizations in Ohio, Pennsylvania, and Puerto Rico. These grants are aimed at establishing new Veterans Business Outreach Centers (VBOCs) to enhance training and counseling services for veteran and military spouse small business owners. The new centers will officially begin their operations on September 1, 2024.

Administrator Isabel Casillas Guzman, who leads the SBA and serves as the voice for over 34 million small businesses in President Biden’s Cabinet, highlighted the importance of expanding the VBOC network. “The expansion of SBA’s network of Veterans Business Outreach Centers has been a top priority of the Biden-Harris Administration as we work to ensure our military-connected entrepreneurs have better access to SBA’s resources to pursue their entrepreneurial dreams following their service to our nation,” said Administrator Guzman. “With these new grants, veterans, service members, and military families in Ohio, Pennsylvania, and Puerto Rico will have local, trusted institutions ready to help them start and grow their businesses – strengthening their communities and our economy.”

Expansion of VBOC Program

This announcement marks a significant expansion of the SBA’s VBOC program, which will now grow from 28 to 31 locations. New York Auto Repair Shop Owner Sentenced to 20 Months for Tax Fraud Conspiracy

A New York man has been sentenced to 20 months in prison for conspiring to defraud the United States by concealing income from the Internal Revenue Service (IRS). Aniello Strocchia, the owner and operator of an auto repair shop in Maspeth, was found guilty of evading nearly $1 million in taxes over a five-year period.

According to court documents and statements made during the proceedings, Strocchia engaged in a scheme from 2013 to 2017 in which he cashed more than $1.3 million in checks made out to his auto repair shop at commercial check-cashing businesses. Instead of depositing these funds into the shop’s bank account, Strocchia concealed this income from his tax return preparers. As a result, the tax returns filed for both his business and personal accounts significantly underreported the shop’s gross receipts, ordinary business income, and his total personal income.

In addition to underreporting his income, Strocchia failed to pay the full amount of taxes he reported as due on his personal returns. Instead of fulfilling his tax obligations, he used the concealed income to fund a lavish lifestyle, which included purchasing a luxury car collection, acquiring a second home, and spending approximately $500,000 on extensive home renovations.

The total tax loss to the IRS as a result of Strocchia’s actions amounted to $989,976.

In addition to the 20-month prison sentence, U.S. District Judge Hector Gonzalez for the Eastern District of New York ordered Strocchia to serve two years of supervised release following his prison term. Strocchia was also ordered to pay $989,976 in restitution to the United States.

The announcement of Strocchia’s sentencing was made by Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division and U.S. Attorney Breon Peace for the Eastern District of New York. The case was investigated by IRS Criminal Investigation, and Trial Attorney Matthew Cofer of the Tax Division prosecuted the case.

Colorado Dentist Charged with Six Counts of Tax Evasion for Alleged Use of Illegal Tax Shelter

A Colorado dentist has been charged with six counts of tax evasion, following an indictment unsealed on Friday by a federal grand jury in Denver. The charges against Ryan Ulibarri, who owns and operates Ulibarri Family Dentistry in Fort Collins, stem from his alleged use of an illegal tax shelter to conceal more than $3.5 million in income from the Internal Revenue Service (IRS).

According to the indictment, Ulibarri purchased the tax shelter in 2016 for $50,000 and subsequently used it from 2017 through 2022 to hide a substantial portion of the income he earned through his dental practice. The shelter was allegedly structured through the creation of three trusts and a private foundation, for which Ulibarri signed trust instruments and opened bank accounts in their names.

The indictment further alleges that Ulibarri restructured his dental practice so that the majority of it was purportedly owned by one of the trusts. He is accused of transferring nearly all the funds earned from his dental practice into these trust and foundation bank accounts. These funds were then allegedly used to cover personal expenses, including the mortgage on his home and credit card bills.

In addition to concealing income, Ulibarri is accused of filing false tax returns for himself and the trusts, improperly assigning the income he controlled and earned from his practice to the trusts. The alleged scheme resulted in a tax loss to the IRS of more than $1 million.

If convicted, Ulibarri faces a maximum sentence of five years in prison for each count of tax evasion. The final sentence will be determined by a federal district court judge, who will consider the U.S. Sentencing Guidelines and other statutory factors before making a decision.

Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division announced the charges. The investigation is being conducted by IRS Criminal Investigation, and the case is being prosecuted by Trial Attorneys Amanda R. Scott and Lauren K. Pope, along with Senior Litigation Counsel Corey J. Smith of the Tax Division.

IRS Announces Unchanged Interest Rates for Fourth Quarter of 2024

The Internal Revenue Service (IRS) announced today that interest rates will remain unchanged for the fourth quarter of 2024, continuing the rates that have been in place. These rates apply to overpayments and underpayments for the calendar quarter beginning October 1, 2024.

For individual taxpayers, the interest rate for both overpayments and underpayments will be set at 8% per year, compounded daily. Corporations will see a slight variation in the rates applicable to them.

Interest Rates for the Fourth Quarter of 2024

  • 8% for overpayments (payments made in excess of the amount owed), with a reduced rate of 7% for corporations.
  • 5.5% for the portion of a corporate overpayment exceeding $10,000.
  • 8% for underpayments (taxes owed but not fully paid).
  • 10% for large corporate underpayments.

Under the Internal Revenue Code, interest rates are determined on a quarterly basis. For individual taxpayers, the rate applied to both overpayments and underpayments is calculated by adding three percentage points to the federal short-term rate. This same formula applies to corporations for underpayments, while the overpayment rate for corporations is the federal short-term rate plus two percentage points.

In specific cases, the rate for large corporate underpayments is set higher, at the federal short-term rate plus five percentage points. Additionally, for corporate overpayments exceeding $10,000, the rate is slightly lower, calculated as the federal short-term rate plus one-half (0.5) of a percentage point.

The rates announced today are based on the federal short-term rate determined during July 2024.

Taxpayers are advised to take note of these rates as they plan for any tax payments or refunds in the upcoming quarter. The IRS uses these rates to calculate the amount of interest owed or due on various tax situations, ensuring that both the government and taxpayers are compensated fairly for any overpayments or underpayments of taxes.

Canva is raising the price of its Teams subscription plan.
In an email sent to current subscribers, the company says the price of Canva Teams is going up to $10 per month per person for a minimum of 3 people.
For many existing customers with just two members on their Teams subscription, Canva says it offering a $20 per month price.
“As visual communication has grown more important, we’ve been investing in more amazing features to add value and help you achieve your goals. This change helps us continue building awesome products like our Visual Suite, Magic Studio, Brand Tools, and other highly requested features,” Canva says in its email.
Canva Teams allows users to collaborate on projects and offers 1TB of cloud storage.

SBA Recovery Centers in Hawaii Remain Open to Assist Those Impacted by Wildfires

The U.S. Small Business Administration (SBA) announced today that its SBA Recovery Centers in Hawaii will continue to provide essential services to businesses and individuals affected by the recent wildfires and high winds. These centers offer a variety of specialized assistance aimed at meeting the long-term recovery needs of the community.

Francisco Sánchez Jr., Associate Administrator for the Office of Disaster Recovery and Resilience at the SBA, emphasized the importance of these centers in the recovery process. He noted that the focus is now on addressing the long-term needs of those impacted by the wildfires, which occurred between August 8 and September 30, 2023. The centers serve as a one-stop location for accessing a range of SBA services, and no appointment is necessary. All services are provided free of charge.

Disaster Loan Assistance

The SBA offers a range of disaster loan options to support recovery efforts:

  • Businesses of all sizes and private nonprofit organizations can borrow up to $2 million to repair or replace damaged or destroyed real estate, machinery, equipment, inventory, and other business assets. Additional funds may also be available to help cover the cost of improvements that protect against future disasters.
  • Economic Injury Disaster Loans (EIDL) are available for small businesses, small agricultural cooperatives, aquaculture businesses, and most private nonprofit organizations to meet working capital needs caused by the disaster, regardless of whether the business suffered any property damage.
  • Homeowners can apply for disaster loans up to $500,000 to repair or replace damaged or destroyed real estate, and up to $100,000 to repair or replace damaged or destroyed personal property, including personal vehicles.

Applicants must now provide a written justification for physical disaster loans; however, EIDL applicants will not be required to provide a written justification until after November 9.

Loan Terms and Repayment

Interest rates on these disaster loans can be as low as 4 percent for businesses, 2.375 percent for private nonprofit organizations, and 2.5 percent for homeowners and renters. Loan terms can extend up to 30 years, with amounts and terms set based on the financial condition of each applicant.

Interest does not begin to accrue until 12 months after the first disaster loan disbursement, with repayment starting 18 months from the date of the first disbursement.
